Regarding any constitution, two basic components are decisive important: One is the unchangeable principles of the constitution, which are mainly related to the structure of the national government, the political regime and the fundamental rights of the citizens, ; and the other is the revision of the constitution according to the variable needs of different generations. There is no doubt that the first component, i.e. immutable laws can violate the second component, which includes some principles of fundamental rights, such as the right to self-determination but in this research, after considering various aspects of the first component, it is concluded that the validity and continuity of these principles will strengthen, maintain and consolidate democracy and protect the rights of citizens.}, keywords = {the people,the constitution,the immutable principles,fundamental rights,Democracy}, title_fa = {اثر الزامات اصول تغییرناپذیر قانون اساسی درحفظ حقوق و آزادی های بنیادین}, abstract_fa = {قانون اساسی اساسنامه حقوقی هر کشوری است و مبنای تنظیم و کنترل روابط بین سازمان های دولتی، روابط دولت با مردم و مردم با یکدیگر در چارچوب فرهنگ سیاسی مبتنی بر قرارداد و رضایت درونی است. در مورد هر قانونی اساسی، دو مولفه اساسی حائز اهمیت می باشد، 1- اصول نوشته غیرقابل تغییر قانون اساسی، که این اصول عمدتاً مربوط به ساختار دولت ملی،رژیم سیاسی و نیز حقوق بنیادین شهروندان است. 2- بازنگری قانون اساسی برای پاسخگویی نیازهای متغییر نسل های مختلف یک ملت و انعکاس ادواری اراده آنها به بازسازی و استمرار قانون اساسی قبلی و حفظ حقوق بنیادین شهروندان است. اگر چه تردید آن وجود دارد که مولفه اول یعنی قوانین غیرقابل تغییر می تواند با مولفه دوم که شامل برخی از اصول حقوق بنیادین مثل حق تعیین سرنوشت در تداخل یا تزاحم باشد، اما در این پژوهش پس از بررسی جوانب مختلف مولفه اول، این نتیجه حاصل گردید که اعتبار و ایستادگی این اصول باعث تحکیم، تحفیظ و حتی تثبیت دموکراسی وحفظ حقوق شهروندان خواهد شد.}, keywords_fa = {مردم,قانون اساسی,اصول تغییرناپذیر,حقوق بنیادین,دموکراسی}, url = {https://www.pfbaj.ir/article_168604.html}, eprint = {https://www.pfbaj.ir/article_168604_1b94c90fcdae3bbaa0ddd30d35b3c03e.pdf} }
