Islamic humanitarian law has established a detailed legal program for armed conflicts based on justice, mercy, and respect for the rights and affairs of humanity, and it pays special attention to people who are not present in the war, and generally includes women, children, the elderly, the sick, etc. In Islamic Jihad, non-combatants of the enemy enjoy immunity as long as they are not effective in combat activities; however, enemy combatants do not only refer to those who are armed and part of the enemy's regular army, but also include all those who are somehow effective in advancing the war in favor of the enemy, even if they do not have weapons in their hands. This article uses a descriptive-analytical method to address the main question of what is the responsibility of states in protecting civilians in armed conflicts in Islamic humanitarian law. The article assumes that in Islamic humanitarian law, all those who refrain from hostile acts of war are considered non-combatants in terms of not participating in the war and their rights are respected. Therefore, people who are not actually military, or who have no evidence of being military, are protected and states and combatants do not have the right to attack them and are responsible for them.
