Abstract

Enjoying hygiene right, physical, social and mental health is considered as one of fundamental concepts of citizens’ rights and second generation of human rights. This right is global, inseparable, interdependent and related case with each other for all human and it is accessible as intrinsic and natural right of all humankind. Now, the question which is posed at this study is that: What does it mean by the right of enjoying hygiene, mental and physical health at Iran, Islam’s rights, international documents and judicial process of European Court of Human Rights? Our reasoning will be such that being forced to follow the right of enjoying sanitation, physical and mental health at Constitution and charter on citizens’ rights, Islam’s rights, different and several documents of international human rights was emphasized as necessary rights and human rights system. Specially, by considering different judicial decisions and judgments rendered by European Court of Human Rights which have been discussed at the end of article, these rights are committal for governmental members of this union. The study method of this research is based on documentary study and content analysis.
