Abstract
Based on the United Nations Charter, the Security Council considers itself to be the only guardian of international peace and security, but in some cases, it does not only help international peace and security. Rather, he and the United Nations are the main violators of human rights. The confrontation of two peace-oriented and security-oriented discourses with the violation of human rights regulations in the light of the power of the United Nations through the Security Council by imposing sanctions on nations and the risk of war cannot be reconciled with human rights regulations and requirements. On the other hand, the abuse of the power of the United Nations and the occurrence of some acts behind immunity have caused crimes in the form of humanitarian regulations to take place and these acts are ignored due to the powerful political structure. Therefore, secondary and derivative propositions resulting from hegemonic supremacy have not presented a realistic discourse in favor of balancing human rights. So, the result is that the idealism and duality in the international system, which is caused by the hegemonic power, has faced a serious challenge to the provisions of human rights and peace and security. Therefore, the structure of international law and the foundation of human rights should be redefined away from mental assumptions.
