The indictment stage, as the beginning or, in other words, the gateway to criminal justice, in English law has been able to take effective action by conducting an initial review of the case before the prosecutor authorizes prosecution, in order to prevent cases lacking sufficient grounds and contrary to the public interest from entering the criminal process, so that only cases in which the conviction rate is determined to be high can enter the criminal process with the aim of improving the criminal justice system and creating a standard trial. However, in Iranian law, due to the investigative nature of the trial system at the prosecution stage, the indictment stage has not been considered so far. At present, considering the aforementioned advantages in English law, the establishment and implementation of a stage in the Iranian legal system called the "indictment stage" does not seem unlikely. The present study, which was compiled using a descriptive-analytical method, concludes after examining the subject that the requirements of the indictment in English law include: the gateway to criminal justice; strengthening the principle of innocence; increasing the fair trial coefficient; discovering the truth in the process of indictment; modifying the absolutist paradigm of criminal law and providing an opportunity for not entering the criminal process. Also, in order to establish the stage of indictment in Iranian law, while turning the judicial system towards accusatory; attention to the requirements of the aforementioned stage is necessary and necessary.
