چکیده

در چند دهه اخیر، اینترنت به زندگی روزمره بشریت وارد شده و استفاده از آن، روزبه‌روز گسترش یافت. این پژوهش به روش تحلیلی-توصیفی باهدف بررسی ماهیت و آثار «دسترسی آزاد به اینترنت» انجام‌شده است. چنین نتیجه شد که اینترنت در نگاه اول یک ابزار بوده و بنا به استدلالات مشابه، استفاده از آن دارای همان ماهیت و اثر حقوقی بوده که برای اصل فعل تعیین‌شده است. بر این اساس، هر آنچه در قانون برای آن مجازات تعیین‌شده در حالت استفاده ابزاری از اینترنت نیز دارای همان ماهیت مجرمانه است. به‌موجب اسناد حقوق بین‌الملل، احترام به حریم خصوصی افراد توصیه شده و نحوه اجرای این اصل به قوانین داخلی کشورها سپرده‌شده که این مسئله نیز یکی از چارچوب‌های حاکم بر اینترنت محسوب می‌گردد. دولت‌ها در تهیه حداقل امکانات دسترسی به اینترنت در چارچوب مصالح ملی، مسئولیت داشته و جز در شرایط خاص، حق قطع این ارتباط را ندارند. در جهت تضمین حقوق برابر همه انسان‌ها، دولت‌ها ملزم به تهیه امکانات اینترنتی خاص برای معلولان و افراد کم‌توان بوده تا قادر به انجام اموراتی باشند که به‌واسطه کم‌توانی، از انجام آن محروم‌اند. درنهایت اینکه امنیت ملی مهم‌ترین دغدغه حکومت‌ها در وضع چارچوب استفاده از اینترنت می‌باشد.
