حق وتو در پرتو قاعده آمره: تعارض عملکرد اعضای دائم شورای امنیت با اصول بنیادین حقوق بین‌الملل

چکیده
قاعده آمره، به عنوان اصول بنیادین و غیرقابل تخطی حقوق بین‌الملل، در تقابل با اختیارات گسترده شورای امنیت سازمان ملل متحد قرار گرفته است که ثمره این تقابل، خطور پرسش‌های مهمی درباره حدود صلاحیت شورای امنیت و تعهد شورا به رعایت این قواعد است. شورای امنیت از یک سو، به عنوان مسئول حفظ صلح و امنیت بین‌المللی، از اختیاراتی برخوردار است که گاه ممکن است تصمیم‌ها و رویه‌های اعضای آن با قواعدآمره‌ای مانند ممنوعیت نسل‌کشی در تعارض قرار گیرد و از سویی دیگر، قاعده آمره، از چنان مرتبه‌ای در نظام بین‌الملل برخوردار است که می‌تواند بر عملکرد اعضای شورای امنیت سایه افکند. در این میان، حق وتو، به عنوان ابزاری انحصاری در اختیار پنج عضو دائم شورای امنیت، می‌تواند به عاملی برای تشدید این تعارض تبدیل شود که وجاهت حقوقی آن در موارد استفاده جهت نقض قاعده آمره زیر سؤال رود. مقاله حاضر با روش تحقیق توصیفی تحلیلی مترصد پاسخ به مسئله فوق‌الذکر است تا با اثبات فرضیه خود مبنی بر لزوم تحدید اعمال حق وتو در موارد نقض قاعده آمره، بر ضرورت بهره‌گیری از ظرفیت مجمع عمومی و دیوان بین‌المللی دادگستری در راستای اجرای ماده 96 منشور تاکید ورزد.
